§ 1. Scope
1. This procedure explains how to report content available on www.eltrike.eu that you consider illegal, and how we handle such a notice.
2. It applies mainly to content published by users on the forum: threads, replies, and the photos and videos attached to them. Any other content available on the site can be reported the same way.
3. Content is illegal if it does not comply with European Union law or the law of a Member State. Content that only breaches the site terms can be reported the same way — we will assess it against the terms.
4. Anyone can use this procedure, including people without an account on the site.
§ 2. How to submit a notice
1. The easiest way is the illegal content reporting form. Every forum thread and reply has a “Report” link that opens the form with the address of that content already filled in.
2. You can also send a notice by e-mail to office@hservice24.pl. Include the same information the form asks for (§ 3).
3. We accept notices in Polish and English.
§ 3. What a notice should contain
1. For us to be able to decide on it, a notice should contain:
- an explanation of why you consider the content illegal — specific, and if you can, naming the provision concerned;
- the exact address (URL) of the content or, if you do not have it, a description of where to find it;
- your name and e-mail address;
- a statement that you are acting in good faith and that the information in the notice is accurate and complete.
2. Your name and e-mail address are not required if the notice concerns child sexual abuse material — such a notice may be submitted anonymously. In that case, however, we cannot confirm receipt or send you our decision.
3. In the form you choose the type of illegality:
- Child sexual abuse material
- Terrorist content
- Hate speech
- Copyright or trade mark infringement
- Defamation or breach of privacy
- Counterfeit goods
- Unlawful publication of personal data
- Something else
§ 4. Confirmation of receipt
1. Once you submit a notice you receive its reference number and, if you gave an e-mail address, a message confirming receipt. Please quote the number in any further correspondence about it.
§ 5. How we handle notices
1. Every notice is reviewed by a member of HService staff — in a timely, diligent, objective and non-arbitrary manner. We do not take decisions by automated means; if automated means were used in handling a notice, the decision says so.
2. We decide without undue delay, usually within 72 hours of receiving the notice. Notices concerning child sexual abuse material and terrorist content are handled first, within 24 hours.
3. Where a notice gives reason to suspect a criminal offence involving a threat to the life or safety of persons, we promptly inform the competent law enforcement authorities (Article 18 DSA).
4. Having reviewed a notice, we either restrict access to the content — it is no longer visible on the site — or dismiss the notice if we find no grounds to act.
5. We inform the notifier of the decision by e-mail, together with information on how to challenge it.
§ 6. Information for the author of the content
1. If we restrict access to content, its author receives a statement of reasons by e-mail (Article 17 DSA): what we did, on which facts, on which legal ground or which provision of the terms, whether automated means were used, and how to challenge the decision.
2. We disclose the notifier’s details to the author only where strictly necessary — in particular in cases of intellectual property infringement. This is decided case by case.
3. If a review shows that a restriction was not justified, we restore the content and inform its author.
§ 7. Challenging a decision and other remedies
1. If you disagree with a decision — as the notifier or as the author of the content — reply to the decision e-mail quoting the reference number. We will review the case again and reply by e-mail.
2. Independently of this, anyone may seek redress before the courts.
§ 8. Notices made in bad faith
1. We may take no further action on notices that are manifestly unfounded or made in bad faith. Knowingly providing false information may give rise to legal liability.
§ 9. Personal data
1. The controller of the data provided in a notice is HService (details in the header). We process it to handle the notice and to meet our obligations under the Digital Services Act (Article 6(1)(c) GDPR).
2. We do not store the notifier’s IP address in plain form — only a cryptographic hash of it, used to prevent abuse.
3. The notifier’s name, e-mail address and IP address hash are erased 180 days after the decision. The record of the case, without those details, is kept as evidence that we met our obligations.
§ 10. Point of contact
1. The point of contact for Member State authorities, the European Commission and the European Board for Digital Services (Article 11 DSA) and for users of the site (Article 12 DSA) is the e-mail address office@hservice24.pl. We correspond in Polish and English.
